Skyline California Privacy Notice

Effective January 1, 2020

This California Privacy Notice supplements the Privacy Policy above and applies solely to California residents (“consumers” or “you”) as defined by the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”). This Notice does not apply to information about our employees or job applicants, which is addressed in a separate notice.

Categories of Personal Information Collected. In the preceding twelve (12) months, we have collected the following categories of personal information from consumers: (A) Identifiers (name, email address, postal address, phone number, account name, IP address); (B) Personal information categories listed in Cal. Civ. Code § 1798.80(e) (name, address, telephone number, credit card number, debit card number); (C) Commercial information (records of products or services purchased, obtained, or considered, purchasing histories and tendencies); (D) Internet or other electronic network activity information (browsing history, search history, interactions with our website and online store); (E) Geolocation data (general location derived from IP address); and (F) Inferences drawn from the above categories to create a profile about a consumer reflecting preferences, characteristics, and behavior.

Sensitive Personal Information. We collect payment card information (credit and debit card numbers) solely for the purpose of processing your transactions through our PCI-DSS compliant payment processors. We do not use sensitive personal information for purposes other than those permitted under the CCPA.

Purposes for Collection. We collect and use personal information for the following business purposes: processing and fulfilling orders; providing customer service; fraud prevention and security; marketing and advertising (with your consent where required); website analytics and improvement; compliance with legal obligations; and communicating with you about your orders, account, and our products and services.

Sale and Sharing of Personal Information. We may “share” personal information (as defined under the CCPA) with advertising and analytics partners for purposes of cross-context behavioral advertising. We do not “sell” personal information for monetary consideration. You have the right to opt out of sharing by using the methods described in the “Do Not Sell or Share” section above.

Your CCPA Rights. As a California resident, you have the following rights: (1) Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business purposes for collection, and the categories of third parties with whom we share your information. (2) Right to Delete: You may request that we delete personal information we have collected from you, subject to certain exceptions. (3) Right to Correct: You may request that we correct inaccurate personal information we maintain about you. (4) Right to Opt-Out of Sale/Sharing: You may direct us not to sell or share your personal information. (5) Right to Limit Use of Sensitive Personal Information: You may limit our use of your sensitive personal information to purposes necessary to perform the services you request. (6) Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.

Your California Privacy Rights
California Civil Code Section 1798.83 permits users that are residents of California to request the following information regarding our disclosure of your personal information to third parties for those third parties’ direct marketing purposes: (i) a list of certain categories of personally identifiable information that we have disclosed to certain third parties for their direct marketing purposes during the immediately preceding calendar year; (ii) the identity of certain third parties that received personally identifiable information from us for their direct marketing purposes during that calendar year; and (iii) examples of the products or services marketed (if we have that information).  If you are a California resident and would like to make such a request, please email us at info @ skyline.com or write us at the address below:

Do Not Track Disclosure. Some web browsers have a “Do Not Track” (DNT) feature that sends a signal to websites you visit indicating that you do not wish to be tracked. Because there is no common understanding of how to interpret DNT signals, our website does not currently respond to browser DNT signals. Instead, you may opt out of certain tracking as described in our Cookie Policy and by using the opt-out mechanisms described above. California residents may also use the “Do Not Sell or Share My Personal Information” link on our website to opt out of the sharing of personal information for cross-context behavioral advertising purposes.

The GDPR (General Data Protection Regulation) is an important piece of legislation that is designed to strengthen and unify data protection laws for all individuals within the European Union. The regulation became effective and enforceable on the May 25, 2018.

What are we doing about the GDPR?
Skyline Exhibits has implemented organizational and technical measures to comply with the GDPR. If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, please note: our online store is primarily directed to customers in the United States. If you access or use our eCommerce services from outside the United States, your personal data may be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using our services, you acknowledge this transfer. We process personal data under the following lawful bases: (a) performance of a contract (to fulfill your orders); (b) legitimate interests (to improve our services, prevent fraud, and communicate with you); and (c) consent (for marketing communications and non-essential cookies). Cookies and Similar Technologies. Our website uses cookies and similar tracking technologies. Essential cookies are necessary for the website to function and cannot be switched off. Non-essential cookies (including analytics and advertising cookies) are only placed with your consent. International Data Transfers. When we transfer personal data from the EEA, UK, or Switzerland to the United States, we rely on the European Commission’s Standard Contractual Clauses (SCCs) as the legal mechanism for such transfers. Automated Decision-Making. We do not use your personal data for automated decision-making that produces legal effects or similarly significant effects concerning you. We may use automated tools to personalize your shopping experience (such as product recommendations), but these do not involve decisions with legal or similarly significant effects.

Right to Lodge a Complaint. If you are located in the EEA, UK, or Switzerland and believe that we have not complied with applicable data protection laws, you have the right to lodge a complaint with your local supervisory authority. I’m new to the GDPR and would love more details on what it is?

The General Data Protection Act (GDPR) is considered to be the most significant piece of European data protection legislation to be introduced in the European Union (EU) in 20 years and will replace the the 1995 Data Protection Directive.

The GDPR regulates the processing of personal data about individuals in the European Union including its collection, storage, transfer or use. Importantly, under the GDPR, the concept of “personal data” is very broad and covers any information relating to an identified or identifiable individual (also called a “data subject”).

It gives data subjects more rights and control over their data by regulating how companies should handle and store the personal data they collect. The GDPR also raises the stakes for compliance by increasing enforcement and imposing greater fines should the provisions of the GDPR be breached.

The GDPR enhances EU individuals’ privacy rights and places significantly enhanced obligations on organizations handling data.
In summary, here are some of the key changes to come into effect with the upcoming GDPR:

• Expanded rights for individuals: The GDPR provides expanded rights for individuals in the European Union by granting them, amongst other things, the right to be forgotten and the right to request a copy of any personal data stored in their regard.

• Compliance obligations: The GDPR requires organizations to implement appropriate policies and security protocols, conduct privacy impact assessments, keep detailed records on data activities and enter into written agreements with vendors.

• Data breach notification and security: The GDPR requires organizations to report certain data breaches to data protection authorities, and under certain circumstances, to the affected data subjects. The GDPR also places additional security requirements on organizations.

• New requirements for profiling and monitoring: The GDPR places additional obligations on organizations engaged in profiling or monitoring behavior of EU individuals.

• Increased Enforcement: Under the GDPR, authorities can fine organizations up to  €20 million or 4% of a company’s annual global revenue, based on the seriousness of the breach and damages incurred. Also, the GDPR provides a central point of enforcement for organizations with operations in multiple EU member states by requiring companies to work with a lead supervisory authority for cross-border data protection issues.

• If you are a company located in the EU, you should already be aware of this. The provisions of the GDPR apply to any organization that processes personal data of individuals in the European Union, including tracking their online activities, regardless of whether the organization has a physical presence in the EU.
