Privacy Policy

 

Skyline Displays, LLC and its affiliates and subsidiaries, including, without limitation, its subsidiary Skyline Retail Sales, LLC (collectively, “Skyline,” “we,” “us,” and “our”) respect the importance of the privacy of your personal information.  We provide this Privacy Policy so you know about our information handling and storage practices and understand how we collect, use, and share the personal information we receive about you from your use of the website on which this Privacy Policy is posted or referenced (the “Site”), or otherwise in connection with our products and services, which could include information received from other sources including our dealers.  By accessing or using the Site or interacting with us in connection with our products or services, you agree to the terms of this Privacy Policy. 

 

Your visit to the Site and any dispute over privacy is subject to the Terms of Service, including limitations on damages and application of the law of the State of Minnesota.  Use of the Site is strictly voluntary.  If you do not agree to our Privacy Policy and Terms of Service, you must immediately log off the Site and may not use the Site.  Additionally, we may not be able to assist you in connection with matters relating to our products or services.

 

Skyline dealers are independent entities, and their processing of information is subject to their own privacy policies.  For information on how a specific Skyline dealer processes your information, please direct your request to that dealer.

1. Your Consent

 

BY SUBMITTING YOUR PERSONAL INFORMATION TO US (EITHER DIRECTLY TO US OR INDIRECTLY THROUGH ONE OF OUR SERVICE PROVIDERS), YOU ARE CONSENTING TO THE COLLECTION AND PROCESSING OF YOUR PERSONAL INFORMATION IN THE UNITED STATES AND TO OUR USE OF YOUR PERSONAL INFORMATION AND ANY RELATED INFORMATION IN THE MANNER DESCRIBED IN THIS PRIVACY POLICY, INCLUDING THE TRANSMISSION TO, AND STORAGE AND PROCESSING OF YOUR PERSONAL INFORMATION BY THIRD PARTIES OUTSIDE THE UNITED STATES.

 

IF YOU ARE SUBMITTING PERSONAL INFORMATION OF THIRD PARTIES TO US, YOU WARRANT AND REPRESENT YOU HAVE THEIR CONSENT TO PROVIDE THEIR PERSONAL INFORMATION TO US AND YOU WILL INDEMNIFY US AND HOLD US HARMLESS FROM AND AGAINST CLAIMS BY SUCH INDIVIDUALS RELATING TO OUR PROCESSING AND USE OF SUCH PERSONAL INFORMATION WITHIN THE TERMS OF THIS PRIVACY POLICY.

 

2. The Data We Collect

 

Anonymous Electronic Information. In general, you can browse the Site without telling us who you are or revealing any personal information about yourself.  However, we collect your computer’s or mobile device’s IP address, which you necessarily disclose when you visit the Site so that data (such as the web pages you request) can be sent to your computer or device.  We may also collect other electronic information such as the type of browser you are using, the operating system you are using, the third party website from which your visit to the Site originated, the domain name of your Internet service provider, the search terms you use on the Site, the specific areas within the Site that you visit, and the time of day and duration of your visits.

 

Cookies. The Site may utilize "cookies," which are text files placed on your computer or device that web pages or screens may use to store data on your computer or mobile device or send data to our web servers.  We may use cookie data to "recognize" you when you return to the Site, to save your user ID, to track usage information, to troubleshoot how the Site operates, and for internal analysis of how people use the Site.  Should you decide not to accept cookies from the Site, you will limit the functionality we can provide you.  For more information, see our Cookie Policy.

 

Additional Electronic Information.  We may use standard Internet technology, such as web beacons, tracking pixels, and other similar tracking technologies, to track your use of the Site. 

 

The Site is not designed to respond to "do not track" requests from web browsers.

 

Location Information. We may collect information about your location if you provide your address or zip code or we may approximate your location based on your IP address. 

 

Through Your Interactions with Us.  When you engage in certain activities on the Site or otherwise interact with us, such as using the Contact Us feature on the Site or making an inquiry with us, we may ask you to provide personal and other information.  The information we will require will depend on the activity and could include your name, email address, contact number, and physical address.  Whether or not you provide this information is your choice; however, if you do not provide the required information for a particular activity, you will not be able to engage in that activity. You may also limit your ability to use all or a portion of the Site.  If you are a registered user of the Site, we may track when and how you use the Site and the operations you perform on the Site. 

 

Information Obtained from Other Sources.  In addition to the information we receive from you directly, we may obtain your name, email address, physical address, phone number, or other similar contact information about you from other companies and organizations, such as marketing and sales generation partners, advertising and analytics partners, your employer, vendors and from service providers that may perform certain operations on our behalf.  We process information received from our dealers to provide them with services as well as for our own purposes in accordance with this Privacy Policy.  We may combine information received from other sources with information we have collected or may collect about you.  We may also collect information that is publicly available.  For example, we may collect information about you when you interact with us through social media. We are not responsible for the accuracy of any information provided by other sources or the data practices of other sources.

 

3. Use and Disclosure of the Data We Collect

 

Generally, we process and use personal information to provide and improve our products and services, including the Site, for purposes in our legitimate interests and for compliance with applicable laws.

 

To Operate Our Business.  We process personal information where: (a) you have given consent to the processing, either to us or to our service providers or dealers; (b) processing is necessary to perform a contract with you; (c) processing is necessary for the purposes of the legitimate interests pursued by us or a third party; or (d) processing is necessary for compliance with a legal obligation.  Some of our lawful bases for processing your information may stem from our independent dealers.

 

We may use your personal information for particular business activities, including, without limitation, responding to your inquiries, providing products and services to you, processing your orders, providing you updates on the status of your orders, customer service and support, customer feedback surveys, marketing and research, conducting contests or giveaways, developing and displaying content tailored to your interests, reviewing your job application, providing product, promotional and other information to you, and to contact you regarding administrative notices or to solicit feedback on your experience with us. 

 

Depending on the circumstances and the nature of the information, we may share this information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, or other companies under common control), Skyline dealers, marketing partners, and other parties with whom we collaborate.  For example, we may share information with a dealer in order to respond to your questions and comments, market and advertise to you, and otherwise comply with applicable law.  In addition, when we use service providers, these service providers may have access to your personal information to perform contractually specified services on our behalf. 

 

To Improve our Business.  We may use your IP address and similar Site use information to: (i) help diagnose problems with the Site, administer and improve the Site, measure the use of the Site, and detect security issues with the Site; (ii) identify the type of web browsers used, the pages viewed, the websites from which a visitor found the Site, and the search terms and search engines used to find the Site; and (iii) gather other analytics information relating to use and navigation of the Site.  This information does not identify you personally.  On occasion we may aggregate this data with data from other users to track overall visitor traffic and usage patterns and provide this aggregate information to vendors, business partners, or corporate affiliates.

 

The information we obtain using standard Internet technology, such as web beacons, tracking pixels, and other similar technologies, enables us to customize the services we offer visitors to the Site, to deliver targeted content, and to measure the overall effectiveness of our online content, advertising, or programming or other activities.

 

We may use your location information to provide personalized content and advertising, to enhance your experience with the Site, to assist us with analytics, and to improve the effectiveness of our Site.

 

We may use the information in an anonymous or aggregated format that does not identify you personally, which uses might include, without limitation, to evaluate existing products, services, and systems; to assist in the development of new products or services; research; advertising; and to identify trends and changes.

 

For Law Enforcement, Regulators and Other Parties for Legal Reasons.  We may also disclose personal information in any of the following circumstances: (a) in response to a subpoena, search warrant, court order, or other legal process or request, or as may otherwise be required by law, rule, or regulation; (b) to protect and defend our rights or property or those of our corporate affiliates, dealers, business partners, or others; or (c) as we, in our sole discretion, believe is appropriate under exigent circumstances in response to a perceived threat to the personal safety, property, or rights of any person or organization.

 

In addition, since our database is a business asset, in the event we are reorganized or become part of another organization, you consent to the sale, assignment, or transfer of your personal information to a successor that acquires substantially all of our business assets, or to a corporate affiliate, as applicable.

 

We do not sell personal information to third parties. Other than as set forth in this Privacy Policy, we do not transfer, share or disclose personal information to third parties.  We do not disclose personal information of individuals we know to be under the age of 16 to other businesses or third parties for consideration except as noted above.

 

4. Google Analytics

 

We use a tool provided by Google called “Google Analytics,” to collect and process information about your use of the Site.  Google Analytics collects information such as how often users visit the Site, what pages they visit when they do so, and what other sites they used prior to coming to this Site.  We use the information we get from Google Analytics only to improve the Site.  Google Analytics only collects the IP address assigned to you on the date you visit the Site, rather than your name or other identifying information.  We do not combine the information collected through the use of Google Analytics with personally identifiable information.  Google sets and reads cookies to collect this data and your web browser will automatically send data collected by those cookies to Google.  Google uses this data to provide us with reports that we will use to improve the Site’s structure and content.  For more information on how Google uses this data, visit Google’s Privacy Policy and Google’s page describing how Google uses data when you use sites or apps that use Google’s services.  You can prevent Google Analytics from recognizing you on return visits to the Site by disabling cookies on your browser.  However, this may impact your use and enjoyment of the Site.

 

5. Children’s Online Privacy Protection

 

The Site is not directed to children under the age of 13 and we will not knowingly collect personal information from children under the age of 13 on the Site.  If we become aware that we have inadvertently received personal information from a child under the age of 13 on the Site, we will delete the information from our records.

 

6. Security of Personal Information

 

We take the security of personal information seriously and we take what we believe to be reasonable precautions and have implemented certain safeguards to protect the security of data and personal information. We may transmit your personal data to third parties outside the United States for storage or processing. We will attempt to ensure that your personal information will be subject to appropriate safeguards and that it is processed and secured in accordance with applicable law. However, we cannot guarantee against any loss, misuse, unauthorized disclosure, or alteration or destruction of data or personal information. While we strive to protect your personal information, we do not guarantee the security of any information you transmit to or from the Site or by email or otherwise, and you provide such information at your own risk. You acknowledge that: (a) there are security and privacy limitations in computer systems and on the Internet which are beyond our control; (b) the security, integrity, and privacy of any and all information and data exchanged between you and us through the Site, including personal information, cannot be guaranteed; and (c) any such information and data may be viewed or tampered with by a third party while such information or data is being used, transmitted, processed, or stored. 

 

7. Our Relationship to Other Websites

 

The Site may contain links to other websites. If you visit one of these other websites, we encourage you to review the privacy policy on that website.  We are not responsible for the policies and practices of other websites, and any information you submit to those websites is subject to their privacy policies.

 

8. Privacy Rights and Requests

 

You may have rights under applicable laws concerning personal information we have collected about you, which may include the right to access your personal information we have, to ask us to delete, correct, or restrict the use of your personal information, to withdraw your consent to our use of your personal information, to ask how we have used your personal information, and to ask whether we have shared your personal information. We will honor your rights to the extent required by us under applicable law or as we may agree to honor in our sole discretion.

All privacy requests relating to your personal information, including those related to access to, rectification of, restriction of, processing of, sharing of, or objection to the processing of your personal information, withdrawal of consent to handle your personal information, the right to be forgotten, or to opt-out of the sale of your personal information (in case our policy changes), can be submitted to us one of the following ways:

All communications must be in the English language.  Please clearly state what information you are requesting and any other requests you are making.  You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly. 

 

We will respond to reasonable requests within the time limits established by applicable law or within a reasonable time if no time limit is established by applicable law.

 

If you or your authorized agent sends us an email requesting that we take action regarding your personal information or the right to be forgotten, the requesting email MUST come from the email address we have on file for you in order to verify that the request is valid and also to protect your personal information.  All other requests must be made in writing or otherwise be verifiable as originating from you or your authorized agent.  In order to protect your information and because people may have the same name, we will only provide or delete personal information that we can verify is associated with your particular email address or where we can reasonably identify the identity of the requestor.

 

For your protection, we may ask you for additional information to verify your identity.  In most cases, we will provide the information you request and correct or delete any inaccurate personal information you discover. We reserve the right, however, to limit or deny your request to the extent permitted by applicable law if: (a) complying with the request may present a threat to the personal safety, property, or rights of any other person or organization; (b) complying with the request may lead to a violation of applicable laws or regulations; (c) we are not required to comply with the request because of a legal rule or exception; or (d) you have failed to provide us with sufficient evidence to verify your identity.  We will not delete personal information if that personal information is related to an ongoing transaction.  Even after a request, we may also keep personal information where necessary to comply with applicable laws or where necessary to protect a legal right or fulfill a legal obligation. 

 

Please note that Skyline dealers are independent entities, and their processing of information is subject to their own privacy policies.  If you wish to exercise any of these rights with respect to the processing of information by a Skyline dealer, please contact your local dealer with your requests, and we will work with the dealer to address your request to the extent required by applicable law.

 

9. How Long We Keep Personal Information

 

We store the personal information we collect about you for as long as is necessary for the purpose(s) for which we collected it, or for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.

 

10. Changes to Privacy Policy

 

We reserve the right to revise this Privacy Policy, in whole or in part, at any time without notice to you. You expressly waive any right to receive notice of any revisions to this Privacy Policy. We encourage you to review this Privacy Policy regularly in your use of the Site to ensure you are aware of current practices. Any use of the Site following the date on which the revised Privacy Policy is published on the Site shall constitute your acceptance of all such changes.

12. Additional Notice for California Residents

 

The following paragraphs apply to the extent the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CPRA”) is applicable to Skyline’s business. This notice describes the personal information that we collect, the sources from which we collect it, the business purposes for which we use it, the limited circumstances under which we share personal information, and with whom we share it.  These additional disclosures, which serve as a Notice at Collection under the CPRA are required by the CPRA.

Your Data Rights

If you are a California resident, you may exercise the following rights (subject to certain limitations at law) conferred by the CPRA in relation to the personal information that Skyline has collected about you. You have the right to:

  • request the deletion of your personal information collected by Skyline and to request Skyline tell its corporate affiliates, Skyline dealers, marketing partners, service providers and other parties to do the same;
  • opt-out of the sale of your personal information by Skyline;
  • request that Skyline disclose what categories and specific pieces of personal information about you that Skyline has collected, used, disclosed, and sold during the last 12 months;
  • not receive discriminatory treatment by Skyline for your exercise of privacy rights under the CPRA;
  • correct inaccurate personal information that Skyline has collected; and
  • limit the use and disclosure of sensitive personal information that Skyline has collected.

 

To make a CPRA request, you may contact Skyline as set forth in the above section (Privacy Rights and Requests).  Skyline will follow the above process to verify and process your request.

 

Personal Information

 

If you are a California resident, the term “personal information” as used in this Privacy Policy means information that identifies, relates to, describes, or is reasonably capable of being linked directly, or indirectly, with, an identified or identifiable person or household whether such data is in individual or aggregate form and regardless of the media in which it is contained, including, but not limited to, an individual’s name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. Personal information” does not include publicly available information that is lawfully made available to the general public from federal, state, or local government records.

 

CPRA Sensitive Personal Information Disclosure

 

The categories of data that Skyline collects and discloses for a business purpose does not include “sensitive personal information” as defined under the CPRA. 

 

Sale of Personal Information

 

Skyline does not generally sell personal information as the term "sell" is traditionally understood.  However, to the extent Skyline sells your personal information as the term "sell" is defined under the CPRA, you have the right to opt-out of the sale of your personal information by Skyline to third parties at any time. 

 

Notice of Collection of Personal Information

 

We describe the personal information we collect, generally, in Section 2 of this Privacy Policy.  In Table 1, below, we list the personal information falling into categories established by the CPRA that Skyline collects or has collected specifically from California residents in the 12 months preceding the “Last Updated” date of this Privacy Policy.  Skyline collects and uses these categories of personal information for the business and commercial purposes described above in Section 3 of this Privacy Policy. The business purposes necessitating the collection of each category of personal information is also included Table 1 below.

 

Skyline may also use the information collected for its own other operational purposes, purposes for which it provides you additional notice, for purposes disclosed elsewhere in this Privacy Policy, or for purposes compatible with the context in which the personal information was collected.

 

Categories of Personal Information Disclosed for a Business Purpose

 

We describe personal information that we disclose for business purposes, generally, in Section 3 of this Privacy Policy.  In that section we also describe the third parties to whom we may have disclosed the information. In Table 1 below, we list the specific categories of third-party recipients to whom we have disclosed personal information from California residents in the preceding 12 months. 

 

Skyline does not disclose personal information of individuals we know to be under the age of 16 to other businesses or third parties for consideration.

This Privacy Notice of Rights explains how Skyline complies with certain privacy rights specifically available to individuals living in the European Economic Area (EEA), the United Kingdom (UK) or Switzerland. This Privacy Notice should be read together with our Website Terms of Service, Privacy Policy, and Cookie Policy.

 

Legal Bases for the Processing of Your Personal Data

If you are a resident of the European Economic Area, United Kingdom or Switzerland, the laws of your country require us to rely on certain conditions to process your personal data. When we process your personal data, we rely on the following conditions or legal bases:

  • Consent;
  • Performance of our agreement to provide services to you;
  • Legitimate interests in providing the services where those interests do not override your fundamental rights and freedoms related to data privacy; or
  • Compliance with legal obligations to which we are subject.

 

Our legitimate interest for collecting your personal data is to conduct and manage our business, and provide products and services for the benefit of our customers and dealers in return for payment. 

 

We use the legal bases set forth in Section 3 and in Table 1 above to process your personal data in accordance with the European Union’s General Data Protection Regulation (GDPR).  Where our legal basis relies on your consent, you may withdraw your consent at any time.

 

The most common scenario where we collect, process and share your personal data is when you contact us about a dealer in your country, which we then share with the appropriate dealer.  Further information on other purposes of our data collection and processing, and third parties to whom we may share it are set forth in the sections and Table 1 above.

 

Your Rights

If you use the Site and reside in the EEA, UK or Switzerland, you are entitled by law to access, correct, amend, or delete personal data about you that we hold under the GDPR and national implementing legislation. 

 

Please review the disclosure and additional rights below.  Please note that these rights are not absolute and certain exemptions apply. To exercise these rights please contact us at the address set forth above.  For your protection, we may need to verify your identity before responding to your request, such as verifying that the email address from which you send the request matches your email address that we have on file. In the event that we refuse a request under rights of access, we will provide you a reason as to why. 

 

The right to access: You have the right to obtain confirmation as to whether we are processing personal data about you, and if so, request a copy of the personal data. This right has some exemptions, which means you may not always receive all the information we process. When making a request, please provide an accurate description of the data you want access to.

 

The right to rectification: You have the right to correct any inaccuracies in the personal data that we hold about you and, where applicable, to complete any incomplete personal data that we hold.

 

The right to erasure: You have the right to ask us to erase your personal data in certain circumstances, including (i) when your personal data is no longer necessary for the purposes for which it was collected or processed or (ii) your personal data must be erased to comply with a legal obligation.  The right to erasure does not apply in certain circumstances, including where the processing is necessary for the establishment, exercise, or defense of legal claims.

 

The right to restrict processing: You have the right to ask us to restrict the processing of your personal data in certain circumstances, including (i) when the accuracy of the data is brought into question or (ii) when we no longer need the data for purposes of the processing but you require such data for the establishment, exercise, or defense of a legal claim.

 

The right to object to processing: You have the right to try to object to our processing even if we are able to process your personal data because the process is within our legitimate interests.

 

The right to data portability: This only applies to information you have given us. You have the right to ask that we transfer the personal data you gave us from one organization to another, or give it to you.  We will give you your personal data in a structured, commonly used and machine-readable format. You may reuse it elsewhere.

 

The right to withdraw consent: If we rely on your consent to process your personal data, you have the right to withdraw that consent at any time. Withdrawal of consent will not affect any processing of your personal data before we received notice that you wished to withdraw consent.

 

The right to lodge a complaint with a supervisory authority. Right to lodge a complaint with the data protection authority: If you have a concern about our privacy practices, including the way we handled your personal data, you can report it to the data protection authority that is authorized to hear those concerns. 

 

Other rights. Under the GDPR you have the right to object to the use of personal data for direct marketing of our products or services to you and how we use Cookies for advertising.

 

How Long We Keep Your Personal Data

We will retain your personal data until the later of (i) the data is no longer necessary to accomplish the purpose for which it was provided, (ii) there is no ongoing business reason to keep the data, or (iii) until you request that your account be deleted.  We retain your personal data for longer periods for specific purposes to the extent that we are obliged to do so in accordance with applicable laws and regulations and/or as necessary to protect our legal rights or for certain business requirements.   We will not change our use of your personal data from the purpose for which we originally collected it from you.
